You must be at least 18 years of age to make a purchase or create an account on the Site. By using the Site, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.

Orion Sleep currently offers two products:

• Sleep Disruption Test — A single-use, at-home diagnostic sensor patch that tracks your core body temperature, temperature fluctuations, and sleep disruptions over one night. Results include a sleep grade and a personalized review from a sleep advisor.
• Orion Sleep System— A smart cooling mattress cover with dual-zone temperature control (50 °F–115 °F), embedded biometric sensors for sleep tracking (heart rate, HRV, breath rate, and movement), a control tower, and access to the Orion Intelligence app. The Orion Sleep System is available in Queen, King, and California King sizes.

The Orion Sleep System includes access to the Orion Intelligence app. Continued access to AI-powered sleep insights, personalized temperature scheduling, and advanced analytics requires an active Orion Intelligence subscription, billed annually. The subscription is optional but recommended for the full product experience. By subscribing, you authorize Orion Sleep to charge your selected payment method on a recurring annual basis until you cancel. You may cancel your subscription at any time through the app or by contacting us. Cancellation takes effect at the end of your current billing period, and no partial refunds will be issued for the remainder of that period.

All prices displayed on the Site are in U.S. dollars unless otherwise indicated. We reserve the right to change prices at any time without prior notice; however, any price change will not affect orders already placed and confirmed. Payment is due in full at the time of purchase unless a financing option (such as monthly installment plans) is selected at checkout. You agree to provide current, complete, and accurate billing information. We are not responsible for orders that cannot be processed due to incorrect payment details.

We currently ship within the United States. Shipping timelines are estimates and not guaranteed. Orion Sleep is not liable for delays caused by carriers, weather, customs, or other circumstances beyond our control. Risk of loss and title to products pass to you upon delivery to the carrier. Free shipping promotions, when offered, apply only to standard shipping within the contiguous United States unless otherwise stated.

The Orion Sleep System comes with a 30-night trial period beginning on the date of delivery. If you are not satisfied, you may initiate a return within the trial period by contacting our support team. The product must be returned in its original condition, free of damage beyond normal use during the trial. Refunds will be processed to the original payment method within 14 business days of our receipt of the returned product. Return shipping costs may apply. The Sleep Disruption Test is a single-use consumable product and is not eligible for return once opened and used.

The Orion Sleep System is covered by a limited manufacturer's warranty against defects in materials and workmanship under normal use. This warranty does not cover damage resulting from misuse, unauthorized modification, accidents, or normal wear and tear. The Sleep Disruption Test is a single-use product provided “as is” without warranty beyond what is required by applicable law. To make a warranty claim, please contact our support team with your order number and a description of the issue.

Certain Orion Sleep products may be eligible for purchase with Health Savings Account (HSA) or Flexible Spending Account (FSA) funds through approved third-party platforms. Eligibility depends on your specific plan and the determination of your plan administrator. Orion Sleep does not guarantee HSA/FSA eligibility and is not responsible for reimbursement decisions made by your plan provider.

Orion Sleep products are consumer wellness and comfort devices. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Sleep data, temperature readings, biometric measurements, and sleep grades provided by our products and app are for informational and wellness purposes only and should not be relied upon as medical advice. Always consult a qualified healthcare professional for medical concerns, including sleep disorders. Do not disregard professional medical advice or delay seeking it based on information provided by our products.

All content on the Site — including text, graphics, logos, images, software, and the design and arrangement thereof — is the property of Orion Sleep or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

You may be required to create an account to access certain features, including the Orion Intelligence app. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

By providing your mobile phone number and opting in to receive text messages from Orion Sleep — whether at checkout, through our website, via a keyword opt-in, or through any other enrollment method — you consent to receive recurring automated marketing and transactional text messages (including SMS and MMS) from Orion Sleep at the mobile number you provided. These messages may include, but are not limited to:

• Order confirmations, shipping updates, and delivery notifications
• Sleep Disruption Test results and sleep advisor scheduling
• Orion Intelligence app notifications and sleep insights
• Promotional offers, product announcements, and special discounts
• Subscription renewal reminders and account-related alerts
• Customer support communications

Consent is not a condition of purchase. You are not required to opt in to text messaging in order to purchase any Orion Sleep product or service.

Message frequency: Message frequency varies. You may receive up to 10 messages per month depending on your order activity, subscription status, and marketing campaigns.

Message and data rates may apply.Your carrier's standard messaging and data rates apply to all messages sent and received. Orion Sleep is not responsible for any charges imposed by your wireless carrier.

Opt-out: You may opt out of text messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message and will no longer receive text messages from Orion Sleep unless you re-enroll. Opting out of text messages does not affect other communications (such as email).

Supported carriers:Text messaging is supported on major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and most other carriers. Carriers are not liable for delayed or undelivered messages.

Privacy: Your phone number and messaging data are handled in accordance with our Privacy Policy. We do not sell, rent, or share your mobile phone number or messaging opt-in data with third parties for their marketing purposes. Information shared via text message opt-in will not be shared with third parties for promotional purposes.

Orion Sleep may send you messages via RCS where supported by your device and carrier. RCS messages may include rich media such as images, carousels, and interactive buttons related to your orders, product updates, and promotions. All opt-in, opt-out, consent, frequency, and data rate terms described in Section 12 above apply equally to RCS messages. If your device or carrier does not support RCS, messages will be delivered via standard SMS or MMS.

By creating an account, making a purchase, or otherwise providing your contact information, you consent to receive electronic communications from Orion Sleep, including emails, push notifications (if enabled in the app), and text messages (subject to your opt-in). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

You agree not to use the Site or our products for any unlawful purpose or in any way that could damage, disable, or impair the Site. You may not attempt to gain unauthorized access to any part of the Site, its servers, or any connected systems. You agree not to use bots, scrapers, or automated tools to access the Site without our express written permission.

The Site may contain links to third-party websites or services (including payment processors, financing partners, and HSA/FSA platforms). These links are provided for convenience only. Orion Sleep does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party sites. Your interactions with third-party services are governed by their respective terms and policies.

To the fullest extent permitted by applicable law, Orion Sleep and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including without limitation loss of profits, data, or goodwill — arising out of or in connection with your use of the Site, our products, or these Terms, regardless of the theory of liability. Our total cumulative liability to you for all claims arising out of or related to these Terms or any product shall not exceed the amount you paid for the specific product giving rise to the claim.

You agree to indemnify, defend, and hold harmless Orion Sleep and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to update or modify these Terms at any time. When we make changes, we will update the “Effective Date” at the top of this page. Your continued use of the Site or our products after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Orion Sleep regarding your use of the Site and purchase of our products, superseding any prior agreements.
